Welcome to IELTS-GPT (“we,” “us,” or “our”). By accessing or using our website at ielts-gpt.com, you agree to be bound by these Terms of Service. If you do not agree, you must not use our services.

1. Description of Services

IELTS-GPT provides AI-powered assessment for IELTS exam preparation, including:

• Writing Task 2 grading — 2 free essays without an account; additional essays with a free account.
• Writing Task 1 grading — requires a free account. Supports text and image uploads (charts, graphs).
• Speaking Practice (Parts 1, 2, and 3) — requires a free account. Includes audio recording, transcription, pronunciation assessment, and AI examiner feedback.
• Band-9 model answers, vocabulary upgrades, error corrections, and actionable tips.
• Pro plan (coming soon) — a paid subscription tier with expanded limits and additional features. Details will be published on our Pricing page when available.

Our feedback is generated by AI models and is intended as a study aid. It does not guarantee any specific IELTS score or outcome.

2. Accounts & Registration

Certain features (Writing Task 1, Speaking Practice) require you to create a free account through our authentication provider, Clerk. Paid features (Pro plan) require a subscription managed through our payment provider. By registering, you agree to:

• Provide accurate information (email address, username).
• Keep your account credentials secure. Each account is for individual use only.
• Not share, transfer, or sell your account access to others.

We reserve the right to suspend or terminate accounts that violate these terms.

3. Usage Limits & Tiers

To ensure fair access for all users, we enforce usage limits that vary by account tier:

• Anonymous (no account): 2 Writing Task 2 essays.
• Free account: Writing Task 2 essays (subject to limits), 2 Writing Task 1 submissions per month, 2 Speaking sessions per month (bonus passes available via testimonials).
• Pro account (coming soon): Expanded or unlimited usage across all features. Specific limits will be published on our Pricing page.

Limits may change at our discretion. We will notify users of significant changes where possible. Upgrading or downgrading your tier takes effect immediately, and usage limits adjust accordingly.

4. Paid Subscriptions (Pro Plan)

When the Pro plan becomes available:

• Billing: Pro subscriptions are billed on a recurring basis (monthly or annually) through our payment provider. You authorize us to charge your chosen payment method at the start of each billing period.
• Cancellation: You may cancel your subscription at any time. Upon cancellation, you retain Pro access until the end of your current billing period, after which your account reverts to the Free tier.
• Refunds: Refund eligibility is determined by our payment provider's policies. Contact us at admin@ielts-gpt.com for billing inquiries.
• Price changes: We may adjust pricing with at least 30 days' notice. Existing subscribers will be notified before any price change takes effect on their next billing cycle.

5. AI-Generated Content

All feedback, band scores, model answers, and suggestions are generated by artificial intelligence (including OpenAI and Microsoft Azure services). You acknowledge that:

• AI-generated feedback is an estimate and may not perfectly match official IELTS examiner scoring.
• Band scores are approximate and should be used as a learning tool, not a guarantee of exam results.
• Model answers are AI-generated examples and should not be memorized or submitted in an actual IELTS exam.
• We continuously work to improve accuracy but do not warrant that feedback will be error-free.

6. User-Submitted Content

Ownership: You retain ownership of all essays, audio recordings, and other content you submit.

Processing: By submitting content, you grant us a limited, non-exclusive license to process it through our AI providers solely for the purpose of generating feedback. Your content is:

• Sent to third-party AI services (OpenAI, Microsoft Azure) for processing.
• For registered users: your essay text, question prompts, speaking transcripts, pronunciation data, and full AI-generated feedback are stored in our database so you can revisit your feedback history from your dashboard.
• For anonymous users (Task 2 without an account): essays are processed in memory and not permanently stored. Only band scores are saved.
• Audio recordings and uploaded images are always deleted immediately after processing, regardless of account status.
• Subject to the data practices described in our Privacy Policy.

Responsibility: You are solely responsible for ensuring your submitted content complies with applicable laws, does not infringe third-party rights, and does not contain harmful, illegal, or offensive material.

7. Reviews

Registered users may submit reviews on our testimonials page. By submitting a review, you agree that:

• Your display name, country, role, rating, and review text may be publicly displayed on our website after approval.
• Reviews must be honest, based on your genuine experience, and not contain offensive, defamatory, or misleading content.
• We reserve the right to approve, reject, or remove reviews at our discretion.
• Submitting a review may earn you bonus usage passes as described on the review page. This benefit may be modified or discontinued at any time.
• You may request removal of your review at any time by contacting us.

8. Prohibited Activities

You agree not to:

• Use the services for any illegal or unauthorized purpose.
• Attempt to circumvent usage limits, rate limits, or authentication requirements.
• Automate access to the services (bots, scrapers, etc.) without our written permission.
• Copy, reproduce, or redistribute any part of our website, content, or AI-generated feedback for commercial purposes.
• Attempt to hack, disrupt, reverse-engineer, or interfere with the services.
• Submit content designed to exploit or manipulate the AI system.

9. Intellectual Property

All website content, including text, graphics, design, code, and trademarks, is the property of IELTS-GPT or its licensors. AI-generated feedback is provided for your personal, non-commercial use. You may save or print your feedback for personal study purposes.

10. Service Availability

We strive to provide reliable access but do not guarantee uninterrupted service. We may:

• Temporarily suspend access for maintenance or updates.
• Modify, limit, or discontinue features at any time.
• Experience downtime due to third-party service outages (OpenAI, Azure, Clerk, hosting provider).

11. Disclaimer of Warranties

Our services are provided “as is” and “as available” without warranties of any kind, express or implied. We specifically disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that:

• The services will meet your specific requirements or expectations.
• AI-generated feedback will be accurate, complete, or error-free.
• The services will operate without interruptions or errors.

12. Limitation of Liability

To the fullest extent permitted by law, IELTS-GPT shall not be liable for any indirect, incidental, special, or consequential damages resulting from:

• Use or inability to use our services.
• Inaccurate AI-generated feedback or band scores.
• Unauthorized access to or alteration of your data.
• Loss of data, revenue, or anticipated results from reliance on our services.

Our total liability for any claim shall not exceed the amount you paid us in the 12 months preceding the claim (if any).

13. Third-Party Services & Links

Our services rely on third-party providers (OpenAI, Microsoft Azure, Clerk, Google Analytics). We are not responsible for the practices, terms, or availability of these services. Our website may contain links to external sites; we are not responsible for their content or privacy practices.

14. Privacy

Your use of our services is also governed by our Privacy Policy, which describes how we collect, use, and protect your data.

15. Changes to These Terms

We may update these Terms of Service from time to time. Changes will be posted on this page with an updated effective date. Continued use of the services after changes constitutes acceptance of the revised terms. For significant changes, we will make reasonable efforts to notify registered users.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States. Any disputes shall be resolved in the courts of competent jurisdiction.
